Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "User", "Customer") and CylixZens ("we", "us", "our", "CylixZens"). By accessing the CylixZens website, creating an account, completing checkout, or using any digital product, configuration, script, or service we provide (together, the "Service"), you confirm that you have read, understood, and agreed to these Terms, our Refund Policy, and our Privacy Policy. If you do not agree to any part of these Terms, you must not use the Service.

You confirm that you are at least 18 years old, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into this agreement.

2. Nature of the Product

CylixZens sells digital, intangible products, including but not limited to Cronus Zen scripts, GamePack configurations, custom anti-recoil tunings, downloadable content, and Discord-based access ("Products"). These Products are delivered electronically and/or by granting role-based access on a Discord server. Once access is granted or the Product is made available for download, the order is considered fully delivered and consumed.

3. License & Permitted Use

Subject to your full and continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Products for your own private, non-commercial use on devices you personally own.

You do not acquire ownership of the Products. All intellectual property rights remain the exclusive property of CylixZens.

4. Prohibited Conduct

You agree that you will not, and will not permit any third party to:

• Resell, redistribute, sublicense, share, leak, lend, rent, or transfer any Product, file, configuration, or Discord access.
• Reverse engineer, decompile, modify, repackage, or create derivative works of any Product.
• Share account credentials, Discord invites, role access, or download links with any other person.
• Use any Product in violation of the terms of service of any game publisher, platform, console manufacturer, or third-party service.
• Use any Product for any illegal, fraudulent, harassing, or harmful purpose.
• Initiate any chargeback, payment dispute, reversal, or "friendly fraud" claim against CylixZens (see Section 5).

Violation of this section will result in immediate, permanent termination of your account, revocation of all Discord roles and downloads, and forfeiture of all amounts paid, without refund. We reserve the right to pursue any and all legal remedies available to us.

5. Payments, No Refunds & No Chargebacks

All sales are final. Because our Products are digital goods that are delivered instantly and cannot be "returned", you expressly agree that:

• No refunds will be issued for any reason, including but not limited to: change of mind, accidental purchase, duplicate purchase, dissatisfaction with performance, incompatibility with your hardware or game version, game updates breaking functionality, being banned by a third party, or losing access to your Discord account.
• No chargebacks, payment disputes, or reversals are permitted. By completing checkout, you waive any right to dispute the charge with your bank, card issuer, or payment processor.
• If you initiate a chargeback or dispute in violation of these Terms, you agree that doing so constitutes a material breach of this agreement and fraud. We will: (a) immediately and permanently terminate your account and Discord access; (b) submit the full evidence of these Terms, your acceptance, delivery confirmation, and access logs to the payment processor to defend the dispute; (c) report the chargeback as fraudulent to Stripe and the relevant card networks; (d) recover any related fees, costs, and reasonable attorneys' fees from you; and (e) blacklist you and any associated identifiers (email, Discord ID, IP, payment fingerprint) from all current and future CylixZens services.
• You authorize us to charge any chargeback fees, processor fees, currency conversion losses, and collection costs back to you.

By completing checkout you acknowledge that you have received the digital Product or access immediately upon payment confirmation, and that this constitutes full and complete delivery.

6. No Warranty & No Guarantees

The Service and all Products are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, either express, implied, statutory, or otherwise. To the maximum extent permitted by law, CylixZens disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted availability, and freedom from defects.

We make no guarantee that:

• Any Product will work with any specific game, console, controller, firmware, or Cronus Zen software version.
• Any Product will continue to work after game updates, console updates, or anti-cheat updates.
• Use of any Product will result in any specific in-game performance, results, kill/death ratio, win rate, or skill improvement.
• Use of any Product will avoid detection, bans, suspensions, or other action by any game publisher or platform. You assume all such risk.
• The Discord server, download links, or any part of the Service will be available without interruption or be free of bugs or errors.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall CylixZens, its owners, operators, contributors, affiliates, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of account access, in-game item loss, account bans, hardware damage, or reputational harm, arising out of or in connection with the Service or the Products, regardless of the legal theory and even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims arising out of or relating to the Service or the Products shall not exceed the amount you actually paid to CylixZens in the thirty (30) days immediately preceding the event giving rise to the claim, or USD $10.00, whichever is lower.

8. Indemnification

You agree to defend, indemnify, and hold harmless CylixZens and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service or any Product; (b) your violation of these Terms; (c) your violation of any third-party right, including any game publisher's or platform's terms of service; (d) any chargeback or payment dispute you initiate in violation of these Terms.

9. Termination

We may suspend, restrict, or permanently terminate your account, Discord roles, downloads, and access to the Service at any time, with or without notice, for any reason, including without limitation any actual or suspected breach of these Terms, any chargeback, or any conduct that we determine, in our sole discretion, to be harmful to CylixZens or other users. Upon termination, all licenses granted to you are immediately revoked and you forfeit all amounts paid. Sections relating to payments, no refunds, no warranty, limitation of liability, indemnification, and governing law survive termination.

10. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page. Changes are effective immediately upon posting. Your continued use of the Service after changes constitutes your acceptance of the updated Terms. It is your responsibility to review this page periodically.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws applicable at the operator's place of business, without regard to its conflict-of-laws provisions. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration, and not in a class, collective, or representative action. You waive any right to a jury trial and any right to participate in a class action.
